Summary

On 14 July 2022 at Naas Circuit Criminal Court Irmantas Cinga of 27 Maynooth Road, Celbridge, Co. Kildare, pleaded guilty to the following ten sample offences contrary to section 1078 of the Taxes Consolidation Act, 1997:

  • Cinga being a director of Loghouse Living Ltd. (in liquidation) formerly of 200 Greenogue Business Park, Rathcoole, Co. Dublin did consent or connive with that company to knowingly and wilfully delivering an incorrect return in relation to VAT for the periods January - February 2011, May - August 2012, May - August 2013, September - December 2014 and November - December 2015 contrary to sections 1078(2)(a), (3)(b) and (5) of the Taxes Consolidation Act, 1997 as amended.
  • Cinga being a director of Loghouse Living Ltd. (in liquidation) formerly of 200 Greenogue Business Park, Rathcoole, Co. Dublin failed to remit VAT to the Collector General for the periods January - February 2011, May - August 2012, May - August 2013, September - December 2014 and November - December 2015 contrary to sections 1078(2)(i), (3)(b) and (5) of the Taxes Consolidation Act, 1997 as amended.

Outcome

On 16 January 2023 at Naas Circuit Criminal Court, Judge Dara Hayes sentenced the said Accused Cinga to be imprisoned for the period of three years but suspended said sentence on the Accused, in open court, acknowledging himself bound to the People of Ireland in the sum of €100, the conditions being that he will keep the peace and be of good behaviour towards all the people of Ireland for a period of three years from this date, on or before the last Friday of each month he will make a future payment of €10,000 to the Revenue Commissioners until twenty-four such payments have been made and not to fall into arrears in respect of any tax due to the Revenue Commissioners and further that he will come up if called on to do so to serve the sentence imposed but suspended on him entering into this recognisance. On imposing sentence the Court took into consideration a further thirty-three counts.
