Summary  

Mr. Oleksandr Vasylkiv, with an address at 4 The Rise, Dooradoyle, Limerick entered a plea of guilty to offences, contrary to Section 78(3) Finance Act , 2005, as amended and contrary to Section 119(2) of the Finance Act, 2001, as amended:

  • Were in the process of delivering specified Tobacco products to wit 2,400,000 cigarettes in a pack or packs upon which Tax Stamps had not been affixed to each such pack. 
  • Did otherwise deal with excisable products to wit, 2,400,000 cigarettes in respect of which a duty of excise was for the time being payable with the intent to defraud, either directly or indirectly the state of such duty.
  • were concerned in the evasion of a duty of excise on excisable products to wit, 2,400,000 cigarettes with intent to defraud either directly or indirectly the State of such duty.     
  • were concerned in the attempted evasion of a duty of excise on excisable products to wit, 2,400,000 cigarettes with intent to defraud either directly or indirectly the State of such duty.     

Outcome   

On 4 December 2024, at Wexford Circuit Criminal Court, Judge James McCourt sentenced Mr. Vasylkiv to 18 months imprisonment. Given the accused credit of 8 months already served with the remaining 10 months suspended for each offence to run concurrently entering a bond for €2,000 to keep the peace for 2 years. A destruction order was granted in relation to the cigarettes. Nolle prosequi for counts 2 and 4, cash found forfeited to the state of €3,610 on consent. By consent the judge deferred imposition of sentence to 5 December 2024 to return the accused to prison to obtain possessions. Sentence imposed as per previous day and bond read out and accused bound.
