This section outlines the Value-Added Tax (VAT) treatment of the management of defined contribution occupational pension schemes.
The Court of Justice of the European Union (CJEU) ruled that defined contribution occupational pension schemes qualify as special investment funds for the purposes of the fund management exemption, where certain conditions are met.
Consequently, Revenue accepts that the management of a defined contribution occupational pension scheme (within the meaning of the Pensions Act 1990) is VAT exempt. However, the management of one-member arrangements does not come within the scope of the exemption and is subject to VAT.
